The Age - 31, August 2003An 81-year-old great-grandmother whose life revolved around her family has been bound and murdered in her home.Phyllis O'Brien was last seen alive by a daughter, but four hours later was found dead in the home she shared with another daughter, Cindy Anderson, son-in-law Darren and the couple's three children, in Katoomba, in NSW's Blue Mountains. "Mum was a loving, independent soul who gave support to us all and who didn't demand very much back," Mrs Anderson said yesterday."Why couldn't they leave her alone? She didn't deserve it."Mrs O'Brien saw family members every day.For the past seven years, Mrs Anderson's family has shared the home with Mrs O'Brien, who was a mother to seven children, grandmother to 21 and great-grandmother to 27.Mrs Anderson discovered her mother's body when she and her family returned from a holiday on Friday."We believe that sometime between 1pm and 5pm Mrs O'Brien was bound and assaulted by one or more people," acting Detective Sergeant Marc Scholtes said.The motive for the attack on Mrs O'Brien remains unclear.

But in covertly scooping it up, had the police broken the law and rendered it useless?Evidently not, because Clarence Herman White, 35, suddenly pleaded guilty to the murder of an 81-year-old grandmother on the strength of a ruling that his DNA was admissible in the case.And it all boiled down to the fact that when police obtained his DNA, he was not a "suspect", but a "person of interest" - that is, a person whom they thought may have been connected with the crime but had no evidence on.The prosecution case was helped by a legislative quirk that differentiates between the two. It also helped that the police did not offer White the cigarette, nor supply it on request.The evidence showed that DNA taken from a roll-your-own cigarette - which White threw on the ground at a police station where he was arrested on another matter - matched that obtained from the fingernail clippings of Phyllis O'Brien. White strangled and bludgeoned Mrs O'Brien to death in her Katoomba home on August 29, 2003.White's defence team had fought against including the evidence on the grounds that police had contravened the Crimes (Forensic Procedures) Act because they never sought White's permission to obtain the DNA.His defence barrister, Stephen Hanley, accused police of classing his client as a "person of interest", rather than a suspect, to avoid that legislative requirement - the act defines suspect only.Had White been a suspect at the time, police would have been required to ask his permission.The difference between the two categories was highlighted in the recent Janelle Patton murder case on Norfolk Island when a large number of locals were declared people of interest.White, who has fathered 13 children to 11 women, was hauled into Katoomba police station on an outstanding warrant a month after Mrs O'Brien's death. He was one of six people of interest.When White asked if he could smoke a cigarette, he was directed by an officer to throw the butt into a corner where there was no rubbish.White had pleaded not guilty when his trial before Justice Timothy Studdert began on Monday, but the trial was delayed pending yesterday's decision.Justice Studdert said the police had not only acted in accordance with the law, but in "good faith"."I do not consider that this is a case in which the investigating police acted flagrantly in breach of the requirements of the statute," the judge said.
Granny killer jailed for 24 yearsJuly 8, 2005 - 2:52PMPage ToolsA man who bashed, bound and left an 81-year-old woman for dead in an alcohol and drug-fuelled search for valuables in her Blue Mountains home has been jailed for up to 24 years.Phyllis O'Brien was found bound and gagged in the hallway of her Katoomba home in August 2003.Her television aerial had been tied around her hands and feet, she had suffered multiple blows to the head and had suffocated on a jumper wrapped around her mouth.Clarence Herman White was today jailed for up to 24 years for what NSW Supreme Court Justice Timothy Studdert described as a "cowardly and callous attack"."Altogether this was an extremely cowardly and callous attack on an elderly lady, and the offender left her bound and helpless on the floor with an admitted appreciation that if his victim was left tied up for too long she would die," Justice Studdert said."Tragically that is precisely what happened."White broke into Mrs O'Brien's home, just 700m from his own, on the afternoon of August 29, 2003, while under the influence of alcohol and drugs.He was on bail for assault and goods in custody offences at the time.When the elderly widow confronted him in the hallway, he knocked her to the ground with his elbow, and bound and gagged her.He then continued to ransack her house, even spitting on her hand to prise a ring from her finger.Justice Studdert said the continued burglary displayed White's "indifference" to his victim's fate."The offender acted with reckless indifference to human life ... being concerned only to take away the deceased's possessions, including the ring he had removed from her finger as she lay helpless on the floor," he told the court.White had originally pleaded not guilty to Mrs O'Brien's murder, but was forced to admit his part when a discarded cigarette linked him to the crime scene.While being interviewed at Springwood Police Station over a separate matter, White threw a cigarette butt to the ground.DNA from the retrieved butt matched that taken from scrapings underneath Mrs O'Brien's fingernails following the attack.Justice Studdert found White's prospects of rehabilitation were poor, and slightly reduced the non-parole period only to reflect his guilty plea.He jailed the 36-year-old for a maximum 24 years, with an 18-year non-parole period.With time already served, White will first be eligible for release in December 2021.Outside the court Mrs O'Brien's youngest daughter Cindy Anderson, who found her mother's body, said the family was still struggling with their loss."(It) left us exceptionally angry, that someone so special for us was treated with such callous treatment ...
